Probate (Summary vs. Formal)

Understanding the Probate Process in Florida

Probate is the legal process through which a deceased person's assets are distributed and debts are settled. At Keefe Law Firm, we guide personal representatives and beneficiaries through both summary and formal probate proceedings with compassion and expertise.

Summary Administration

Summary administration is a simplified, expedited probate process available in Florida under certain conditions:

  • The value of the entire estate subject to probate is $75,000 or less, or

  • The deceased has been dead for more than two years

  • No creditor objections or disputes among beneficiaries

  • Typically completed in 1-3 months

  • Lower attorney fees and court costs

Formal Administration

Formal administration is the standard probate process for larger estates or more complex situations:

  • Required for estates valued over $75,000

  • Involves appointment of a personal representative

  • More comprehensive creditor notification and claim process

  • Typically takes 6-12 months or longer

  • Higher level of court oversight

  • Necessary for complex assets or contested estates

Our experienced probate attorneys will assess your specific situation and recommend the most appropriate process. We handle all aspects of probate administration, from filing initial petitions to distributing assets and closing the estate.

Personalized Guidance: We understand that probate often occurs during a difficult time of loss. Our attorneys provide clear explanations of the process and compassionate support throughout the proceedings.
